Muslim dress case goes to Lords

A school found to have discriminated against a student for wearing traditional Muslim dress in breach of its uniform policy is to take its case to the House of Lords. Governors of Denbigh High School in Luton, Bedfordshire, have been given leave to appeal over their exclusion of pupil Shabina Begum.

Miss Begum, 16, who was 15 when she was excluded, won a landmark ruling in March when the Court of Appeal ruled that the school had breached her human rights and unlawfully excluded her for wearing a jilbab to lessons. The school — which is 79 per cent Muslim — had argued that the jilbab, which leaves only the hands and face exposed, contravened its uniform policy, which had been agreed with local Muslim organisations.

Ms Begum’s lawyers argued successfully that the school’s action had denied her the right to education and to manifest her religious beliefs, in breach of the Human Rights Act.

Three law lords have now given permission for the school to challenge the decision. The case is estimated to have cost taxpayers more than £100,000 in legal bills so far.
