A veteran radio presenter who had been hailed by his radio station for "verbally assaulting callers" was sacked today after breaking strict broadcasting impartiality rules.
James Whale, touted by talkSPORT as having a confrontational style that would "have Attila the Hun running for the hills", had used his night-time show on March 20 to call for Londoners to vote for Boris Johnson in Thursday's mayoral poll.
The 56-year-old, who worked for the company for 13 years, was sacked after bosses termed the move a "gross error of judgment" which had broken Ofcom rules. The regulator had been investigating complaints made after the show.
"It’s very unfortunate. We have investigated the matter and after serious consideration, the station reached the decision that there was a clear breach of the rules and that we had no choice but to terminate his contract," talkSPORT said, in a statement.
"James Whale is guilty of a gross error of judgment which we found to be totally unacceptable.
"TalkSPORT has acknowledged the seriousness of the complaints received, does not excuse the content of the broadcast, and has told Ofcom that it has taken steps to prevent this happening again.
"The matter is still under investigation by Ofcom so it would be inappropriate to comment any further on the details of the complaints."
By this afternoon, talkSPORT had already removed any reference to Whale's show from their website. His picture had been replaced by that of Tom Rivers, another presenter.
A profile of the 56-year-old presenter, which remained on the site, hailed his ability to "offend" people.
"You know you are in the presence of someone special when you look at the number of people James Whale has managed to offend over the years," it said. "Whether you’re pushing 80 or still collecting My Little Pony, if you annoy Whale, he’ll soon let you know about it."
It added: "The outspoken and self-righteous late night king has developed a cult following over the years with his confrontational style that would have Attila the Hun running for the hills.
"James loves nothing more than verbally assaulting callers on his late night phone-ins and it seems people on the other end of the line can’t get enough as we’ve gone through eight switchboards in the last two years."
Whale's agent Stuart Hobday told the BBC that Whale was "deeply disappointed" with the decision.
"He’s spent 13 happy years at TalkSPORT," he said. "He’s saddened at the way this has happened and it’s come as a huge shock."

Love him or hate him - there is no substitute for James Whale on the airwaves. Whether you agree with his views or not he is interesting and entertaining. His eveninig slot has been filled with a collection of insipid pretenders, and I'm sure ratings have dived. If you value ratings bring him back.
Andy, Solihull, UK
James attracted listeners from all sides of the political spectrum. The regular listeners knew that James had a very rough exterior but underneath he had a heart of gold. Talksport are the real losers here!
Bernadette - East London.
Bernadette McGregor, London, England
I disagree with the Whale on lots of subjects. But I love his show and his anti political correctness to bits. Are we all New Labour/Tory/Liberal clones. Have we not the right to think and in doing so make our own minds up? James Whale or Jesus could sway me to vote for anyone. Whale back now!
Ed Mackan, Belfast, Ireland
I feel the same as everyone else posted on here, BRING BACK THE WHALE! It's just not the same without him. Like someone has already said, just one brilliant presenter left and thats Mike Mendoza, thank god he's still there. We need James back on Talksport, PLEASE.
Alison, Newbury, UK
Hate him, or love him, It cannot be denied that James Whale is one of the country's best communicators. With so much dross taking up time on the airwaves today, it's a travesty of justice to gag him. As is the case in America, the gutless bosses of radio stations pander to their advertisers.
james banville, woking, uk
New late night Talksport presenters aren't a patch on the mighty James Whale. Don't bother listening to the station now.
Phil Johnson, Northampton, UK
bring james back, miss him, will not listen to talk sport till he comes back
audrey wright, Stourbridge, united kingdom
The Uk's Howard Stern - he should now join LBC - he needs to stay with radio, he is the best we have.

Absolutely gutted about James, I was a regular listener and will now follow him to his new slot on internet radio Play UK starting at 6.00pm on Tues 20th May. Needless to say I will no longer listen to Talksport. (can't stand sport anyway)

Rightly or wrongly James dismissal is another frustration for the free speech we apparently enjoy and the claimed democracy we live in today.
What is clear is that the airwaves will be very much poorer without his comments that represent so much of what the man in the street is concerned today.
Garry O'Keefe, London, England
What is so sad is the complete lack of acknowledgement from the other presenters (e.g. Ian Collins) of Whale's sacking. I haven't heard a single word on Collins's show regarding this, so I can only assume it's a banned topic.
Happily, Boris got in, so Whale's sacking wasn't all in vain. :)
Dave, Sheffield, UK
I don't understand why James Whale is sacked for SUPPORTING Boris while LBC presenter James O'Brien gets away with his relentless outspoken ATTACKS on Boris.
Kev Delaney, London, UK
Talk Sport is nothing without James.
I loved listening when Ken from the Highlands phoned.
The broadcasting rules are RIDICULOUS.
Bring back the Whale!!!!!!!!!!!!!!!!!!!!!
karen, stoke poges, england
The hypocrisy of Talkspoprt is unbelievable. Since UTV took it over, it has fired Charlie Wolfe and Whale - two presenters on the right of the political divide - while hiring far-left loony George Galloway. How Galloway's detestable rhetoric can be deemed acceptable under Ofcom rules is beyond me.
John, Manchester, UK
Very disappointed with Talk Sport. The sacking of James Whale is a disgrace. I have been listening to his nightly program for years and found him very entertaining with interesting topics and guests . Needless to say I will not be tuning in to Talk Sport again.
Marina Gilliland, Annan, Scotland
What a sad day that someone who says what other people think and not afraid to speak the truth is taken off air...Ive listened to James for years and will miss him on talksport
Martin Prince, Nomansland,Wiltshire, uk
I Wont Listen to Talksport again, When you listen to James on Air You have to Expect to hear Radical views, If you don't like it you should turn the radio off, This Sacking just proves the Nanny state this Country has. The very one that James always fought against !
stuart, Guildford, englans
james whale is an institution for this country and finds truths to tell the people of the country .its a sad day when whaley cannot broadcast to the nation.there are rules and james made 1 mistake in 13 years at talk sport.i will sadly miss james and ash,jim bradford.
james webb, bradford,west yorks,
Talksport has lost another listener.
I'm so sad I've even written a letter to Boris Johnson to see if Talksports decision can be reversed. Night times without James & Ash is unbearable, I feel as if I've lost a close friend. Do we still have freedom of speech in England?. Bring James back please.
Mrs, B. Groom, Filey,
I fail to see any gross misconduct, I think sacking him is way over the top. It's wrong to build up a case against him using previous matters, they should have been completely dealt with at that time. I feel he'd have a field day if he went to a tribunial. He a legend around these parts!
RayB , Newcastle upon Tyne, UK
For any of you who miss his show. He is now doing it on his website. www.jameswhaleradio.com
Andrew, Newcastle,
Very disappointed to hear of the sacking of James Whale , we have listened to his nightly banter for years , both me and the wife enjoyed his views on his late night show . We always found he spoke for the people of this country , perhaps too out spoken at times but very enjoyable listening .
WJ Sturdee , huntingdon, uk
The presenter should be able to express his opinion as long as he states that these are his views and feelings, not the BBC's.
People can make there own minds up, it's interesting to listen to his opinion.
It's shocking they are stopping his free speech.
Andrew T, England, UK,
I would not have voted for Boris Johnson just because James Whale said it was the right thing. I agreed with very little he said but defend his right to say it. Most of the time he was not a "Shock Jock",he had a wonderful sense of humour and I enjoyed his style in contrast to the lefty liberals
R Grant, Canterbury,
Talksport, has lost a listener with me there worse that Clowns there just Tossers they should have a listen to see what the other presenters say, theres only one good one left Mike Mendoza after that nothing.Talksport yeah !! football football football, horse racing, fishing oh and
football crap
John K, Wrexham,
Perhaps some of your posters need to get the message that what Whale did was illegal. There was an election going on. He was not, therefore, able to make comments for or against one of the candidates. He did, case closed!
Brian Capaloff, Falkirk , Scotland
i only listen to talk sport for james whale i wont be listening again, just because he has a different option.
jo wolfenden, halifax, w yorkshire
I reckon they wanted a cheap way of getting rid of him. He's hardly the first presenter to support a candidate in an election. The BBC did it all the time when they were trying to get Labour elected. Thank heavens Ken is gone and let's hope the Whale gets a better job elsewhere.
David Tyne, Amersham,
talk sport bosses bunch of clowns & no backbone 2 no complaints probarbly gordon brown & ken the ex mayor do they think people are that stupid they can not make up there own minds on the subject of mayor of london come on get real maybee he will get a call from boris what a combination
p summlar, birmingham,
Talk Sport will lose a lot of listeners because of this. No matter how good his replacement there will NEVER EVER be another Whale. The integrety of the whole Radio Station has plumeted.
We'll all miss you James....there'll never, ever be anyone else to replace THE WHALE.
Marjorie Wilson, Edinburgh, Scotland
Listening to his show around chrismas, James said that he was unlikely to continue into the new year. He seemed increasingly annoyed by the way that Talksport's sport's coverage was eatting into his show. It seems that Talksport have used the Boris incident to get rid of him.
Martin, London, England
I have been listening to him for many years and without him, talksport will never be the same again. It appears now that I may have to switch to the BBC.
James Morley, Leicester, UK
It is a real shame as James is a living legend and will be deeply missed by his army of fans including myself. I'm sure the job offers will come rolling in. I'm sure people would have made up their own minds as who to vote for.
James you were the best! Long live James
D Jenkins, Birimgham, UK
It is silly to condam some one when whole of London is saying that Ken lost is way and started to believe that he has greater that than the people elected him in the first place. I am one of them
badsha, Kentish Town, UK
i am very sorry to see James go.....I have listened to him for over 10 years!!! a big mistake to let him go...i have now gone over to radio 5live. James is a decent person who enjoys his job and entertains so many people who either work late or just have problems sleeping like myself!! T. Deans
Tina Deans, Bristol, England
Its funny how speech can be considered such a weapon in 2008. Opinion and speech should not be a crime, except to those who hold crimes themselves. The truth only makes the world better and without the truth, evil can move without being seen or revealed. Speech should never be a crime.
Tim, Madison, United States
Most people did not listen to him waiting for him to offend people. It happened rarely,he was interesting and ,with Ash,had a great sense of humour. He was worth more than some of the BBC's Airheads and will be missed.
R Grant, Canterbury,
