David Southall, the controversial paediatrician, inappropriately accused a grieving mother of killing her son by hanging him, a misconduct hearing ruled yesterday.
Professor Southall, 59, was formerly found guilty of serious professional misconduct after his role in the case of Sally Clark, who was wrongly jailed over the death of her two sons.
In the latest case, he was said to have acted like a “Crown prosecutor” when he accused the woman of murdering her ten-year-old son by “hanging him up and leaving him to die”.
The General Medical Council ruled yesterday that his actions were “inappropriate, added to the distress of a bereaved person and were an abuse of his professional position”.
He also removed medical notes to create “special case” files on children and was found guilty of a series of other allegations relating to children in his care during the 1980s and 1990s.
A fitness-to-practise panel will decide later this week whether Professor Southall is guilty of a charge of serious professional misconduct, which he denies, and whether he should be struck off the medical register.
Professor Southall was suspended from child protection work in 2004, having been censured after interfering in the Sally Clark case. He had accused Mrs Clark’s husband, Steve, of murdering the two boys on the basis of a TV interview, and suggested that the couple’s third child was at risk. Mr Clark was completely exonerated. But the family said that his wife never recovered from the trauma of her ordeal: in March she was found dead.
The latest misconduct hearing began in November 2006.
The GMC’s fitness-to-practise panel was told that Professor Southall aggressively interviewed the woman, referred to as Mrs M, and asked her to demonstrate the moment that she found her dead son, known as M1, using a pencil and shoestring. A second mother, known as Mrs H, claimed that he had treated her son like a “lab rat” and accused her of abusing her ill child.
This year the Attorney-General ordered a special review of criminal cases in which he had acted.
The panel ruled that he “damaged the integrity” of hospital medical records by removing documents and adding them to his own files.
Professor Southall, who worked at the Royal Brompton Hospital in London and then the North Staffordshire Hospital NHS Trust, kept “special case” files on two children, the GMC panel was told.
Mrs M had been interviewed by him in 1998 at the request of a local authority after concerns were raised about the safety of her younger son, who had been taken into care. The boy was 8 when his ten-year-old brother hanged himself in 1996. But Professor Southall barely asked Mrs M about her other son, and instead accused her of having Münchausen’s syndrome by proxy and murdering her eldest boy.
Giving evidence via video link from Adelaide, Mrs M described the interview: “Professor Southall turned to me and said, ‘I put it to you that you killed your son by injecting him, hanging him up, leaving him there and then ringing an ambulance’,” she said.
Jacqueline Mitton, chairman of the panel, said: “It had been found you failed to respect Mrs M’s dignity.” It was also found that he failed to treat her “politely or considerately”, in a way that she could understand, that was inappropriate and caused her distress. Professor Southall’s handling of medical records in relation to four other children also came under scrutiny. He was cleared of effectively setting up secret computer medical records.

Why did Shropshire County Council ask Dr Southall to provide a report in the above case?
Was it because the mother of the dead boy complained about him being bullied at the Oswestry primary school and the school did nothing ans so the mother told her son to "hit back", which he did after another lad had kicked him.

Was the mother of the dead lad considering legal action against Shropshire County Council who then used Dr Southall's 'expert' report as a pre-emptive strike to neutralise a problem parent?

The General Medical Council's decision in GMC v Southall is a travesty of justice. It shows a complete lack of understanding of the issues surrounding child protection. Moreover, the independent witness in the Southall case categorically stated that Southall did not make the comments he is accused of. The GMC though preferred the mother's point of view. This leads us all to question the criminal standard of proof as operated by the GMC.
The decision means that no chaperone, no person accompanying the doctor in an assessment of a patient will be taken seriously by the GMC. Indeed, the decision poses a danger to child protection professionals working in a tough terraine. Many doctors will now be reluctant to engage in this speciality. The net result will be a serious risk to children and an increase in child abuse.
The General Medical Council gets it wrong many times. The Shipman Inquiry as well as the Public Policy Institute Study states that.

I was diagnosed as a malingerer by a doctor, despite my GP & rheumatologist treating me for my worsening condition. I had to give up work . My firm believed the doctor, as a result, I lost my pension, the pain of being stigmatised a malingerer has done me untold damage since then. How can one person make incorrect & damaging decisions that overturn peoples lives? I feel Mrs M's pain & the anguish that Sally Clark & her family went through. I was advised by the ombudsmen that my option was to take the case to court, had I the funds, I would readily have done so.

Southall is a deluded individual, however he is not to blame. The CPS only engage individuals who are biased toward the prosecutions case no matter what the real science behind the evidence, this is why they employ at tax payers expense the most wayward of experts to substatiate their cases. The fact is that until an independent organisation is set up that wont work hand in glove with the Police you will always have this problem. Its not Southall to blame but the system that allowed him to stand as an expert witness.

Southall was appointed as my childs consultant at UHNS, he threatened myself with child protection services if I did not take my child home from the ward, this was whilst under the Ban from doing child protection work. I informed the GMC, they took no action.I asked for him to be removed as consultant and He refused, Copies of correspondence in this matter will be available both on my childs medical records and my own. I Asked the Chief Exec to remove him as consultant, gave my reasons and he was removed. This man is obsessed with labeling parents as unfit, we have gone head to head on many occasions. He attended a care review meeting and took medical letters regarding my child out of context, attempting top portray myself as endangering my child, I again challenged him in open discussion, and the full letter was read out, in the proper context, again whilst under his ban. I hope he is struck off, I do not believe his input is in the best interests of any child.

Isn't this further evidence that the GMC is incapable of dealing rationally with such serious cases? Disciplinary hearings should be heard by an independent body, not doctors' own governing body which ultimatey serves to protect the interests of their profession and not the interests of patients and the public? Being struck of the register seems inadequate for someone who abused their professional standing and caused grieving families further trauma, and for Sally Clark an unwarrented prison term, depression and an untimely death.

He will just get a slap on the wrist. like "Sir" Roy Meadows who should have been stripped of his knighthood. Lestor Piggot had his honour award rescinded for tax irregularities, but money crime is more important than crimes against grieving parents.
45 years ago when I lived at Esher, I was talking to my neighbour as she put her lovely little boy down for a nap. Two hours later I heard her screaming and rushed out to see what was the matter. We called an ambulance but nothing could be done. She was taken to the Police Station and accused of killing her son, and her daughter was taken into foster care. An autopsy found the cause of death was "cot death" as it was known then. Meanwhile she had been through hell at the police station and her daughter was traumatised. The Police convinced her husband she had killed him. They got divorced later. I hoped those bad old days were gone for good, but these two evil men were determined to bring them back.

The Medical Council has severely damaged its own credibility and the medical profession at large by failing to act robustly in a case where one of its members blatantly abused the power of his position to wilfully and irreparably dmage the lives of so many people. Münchausenâs syndrome by proxy is incredibly difficult to diagnose and still under scrutiny as to whether it is a valid disorder. The God Complex of which apparently David Southall suffers is much more clearly documented and easier to spot. Incidentally why was a so-called doctor who could allegedly diagnose so much through a TV interview was not critically examined by his own profession sooner? A jail sentence at least equal in length to Sally Clarke's may work wonders on his powers of contemplation.

What an appalling and arrogant man! I wonder why those working with him over the years did nothing to put a stop to his unethical activities. Fearful for their own careers perhaps? Or maybe just a combination of inertia and not wanting to rock the boat. So much easier to turn a blind eye to wrongdoing, isn't it? Will the GMC bottle out of striking him off? Watch this space!
