Sir, There are many unresolved issues attending the purchase by the Tate of The Upper Room by one of its trustees, Chris Ofili (report and leading article, October 28). The Tate justified the purchase on the grounds that it was “a unique opportunity . . . not likely to come again”, yet initially refused to divulge the price as it would hamper negotiations for “similar” works.

The five benefactors you mention, who were privy to the imminent purchase, which would surely boost Mr Ofili’s career and market value, were said to be interested in buying their own Ofili works, according to the Trustee minutes. It needs to be established if this did actually happen.

The minutes, obtained under the Freedom of Information Act, appear to reveal token board discussions, among which was the desire to acquire the work “come what may”. There is no discussion recorded as to whether the fundraising drive could be better directed to any other artist or artists, nor does there seem to be any record of an independent valuation.

Mr Ofili is bound by the Nolan principles of conduct in public life, the first of which is selflessness. I suggest that he clear his reputation by refunding the money, thereby donating his “most important work to date”. Mr Ofili has called for other artists to make donations of work to the Tate. He now has the responsibility to stand by his words.
