Pakistan sentence

Sir, You draw attention to the very serious legal, procedural and evidential defects which point to the death sentence that has been passed on Mirza Tahir Hussein being, at best, unsafe and, at worst, a travesty of justice (leading article, Oct 20).

There is a wider dimension; President Musharraf has postponed the execution on the intervention of Prince Charles, not that of Tony Blair or other leaders of democratic states. The decision of the sharia court overruled the decision of the secular High Court of Pakistan. If President Musharraf is so in thrall to the sharia court to allow it to take precedence over the rule of law as laid down by the Constitutions, then we should indeed be worried. If Pakistan were to be taken over by fundamentalists it would have a devastating effect on the stability not just of the region but of the whole world.

The answer is for Mr Musharraf to invoke Article 45 of the Constitution of Pakistan and exercise his absolute right to pardon him, which would involve no loss of face.
