Binyam Mohamed, the former British resident who claims he was the victim of US rendition and torture, was released from detention at RAF Northolt tonight after arriving back on UK soil from Guantánamo Bay.
Clive Stafford Smith, Mr Mohamed's lawyer, said the former detainee was emaciated but "grateful to be back in Britain".
"He does expect to stay in this country," he added.
Mr Stafford Smith confirmed he had reached a deal with the Home Office over his living arrangements in Britain. The lawyer refused to say what the deal entailed, but is believed that Mr Mohamed has to report regularly to the UK authorities and has accepted that he will be kept under surveillance. He has also agreed to be interviewed by the British police.
Mr Mohamed, who arrived back on British soil this morning after being held at the US detention facility since 2004, is not expected to be placed under a control order, which would restrict his movements and limit the people he is allowed to speak to. As a foreign national, he has been granted temporary admission to the UK but his immigration status will be reviewed. He will be allowed to seek NHS treatment.
“He is a victim who has suffered more than any human being should ever suffer,” said Mr Stafford Smith. "He just wants to go somewhere very quiet and try to recover.
"There is zero doubt in my mind that the British Government was implicit in the who process that was involved in his torture."
The 30-year-old touched down at RAF Northolt, to the west of London, on board a chartered jet at about 1.15pm.
Appearing hunched and thin and wearing a white cap pulled down over his eyes, Mr Mohamed shambled down the aircraft steps and was met by security staff.
He was accompanied on the flight by officers from the Metropolitan Police Counter-terrorism Command, a uniformed police escort team and a doctor.
At a press conference this morning his US military lawyer, Lieutenant Colonel Yvonne Bradley, said that he was in poor physical and mental state after reportedly being on hunger strike for the past few weeks. "I know he is fit to travel, but that is pretty much a minimum status for him," said Colonel Bradley.
"I know he is going to have to put on a lot of weight as he was at least 40-50lbs underweight when I last saw him. [Recovering] mentally is going to be a longer process, given the ordeal that he has gone through."
