Natallie Evans, who had her ovaries removed because of cancer, is asking the court to consider whether UK law, which requires her six stored embryos to be destroyed, is a breach of her human rights.
At the hearing tomorrow the European Court will decide whether the Human Fertilisation and Embryology Act 1990 breaches her right to respect for private and family life and her right not to be discriminated against. Muiris Lyons, of the solicitors Alexander Harris, said: “These embryos represent her last chance to have a natural child of her own.”
UK law requires her embryos to be destroyed because her former fiancé, who had consented to the embryos being created for her use, changed his mind after they broke up.
Ms Evans went to the High Court for an order that she should be permitted to use the embryos, but was unsuccesful. The Court of Appeal rejected her claim and the House of Lords refused her leave to appeal, so the Strasbourg court is her only hope.
