1. Post-charge questioning: Give police the power to continue questioning a suspect once they had been charged with an offence.
2. Legislate to make it clear that Parliament wants control orders to involve curfews of up to 18 hours. The courts have ruled this unlawful saying it amounts to house arrest, forcing Home Secretary to impose much shorter curfews.
3. Allow phone tap evidence to be admissable in trials: Government has ruled this out on the grounds that it does not want to disclose methods involved; also doubtful that GCHQ yet has the ability to intercept voice over internet communications.
4. Derogate from European Convention on Human Rights: UK would withdraw from Article 5, the right to liberty on the basis that there is an emergency threatening the life of the nation. Would need approval of both Houses of Parliament. Would allow the courts to impose restrictions up to, and including house arrest, on the “balance of probablities” that a person was involved in terror.
5. European wide modernisation of human rights laws to reflect the situation now facing states - ending the distinction between armed conflict and criminal acts.
