A shopkeeper could be charged with murder after an armed robber who tried to steal the day’s takings was stabbed with his own knife during a struggle.
Tony Singh, 34, described as a hard-working family man who often works 13-hour days, was ambushed as he shut his shop on Sunday evening by Liam Kilroe, 25, a career criminal who was armed with a knife.
Mr Singh fought back and, after a fierce hand-to-hand struggle, Kilroe was seen by witnesses to stagger away clutching the knife to his chest. Kilroe was taken to hospital, where he died, and Mr Singh was detained by police. He is now waiting to discover whether he will be charged, and is on police bail until February 29 pending further inquiries.
Lancashire police confirmed that papers had been sent to the Crown Prosecution Service, which will decide whether Mr Singh should be charged with one of three offences: murder, manslaughter or assault.
Mr Singh, who suffered injuries to his neck and back during the struggle and had to be treated in hospital, insisted yesterday that he had acted in self-defence. The shopkeeper, who runs the Lifestyle Express general store in Skelmersdale, Lancashire, said: “I feel lucky to be alive. All I was doing was trying to stop myself getting hurt. The guy could have killed me.
“I have got some injuries to my face and I am pretty shaken up but, thankfully, I am OK and able to return to work. It could have been so much worse. If one of the wounds had gone one inch either way, then it could have been fatal for me.”
Kilroe, of Billinge, near St Helens, who had convictions stretching back nine years, was in breach of bail conditions at the time of his death. He had failed to appear in court to answer charges that he carried out armed robberies at a shop and post office with an imitation firearm. In one raid a postmaster was hit over the head with a handgun but the robbers fled empty-handed. In a second robbery, at a general shop in Croston, Leyland, they forced a woman behind the counter to open the till at gunpoint and hand over £8,000.
Kilroe’s trial was scheduled to go ahead in his absence earlier this week at Preston Crown Court until Judge Christopher Cornwall was told that the accused had died.
Mr Singh had just shut his store at 9.40pm on Sunday and was about to drive home when Kilroe struck. He smashed the driver’s side window of Mr Singh’s Ford Focus with the butt of his knife and reached in to demand the takings. The shopkeeper resisted.
At the end of the struggle Kilroe was seen to stagger away from the scene with the knife in his chest then stumble to the ground. A number of people witnessed the confrontation and have given statements to police.
Mr Singh’s customers and fellow shopkeepers offered their support yesterday. One said: “Tony is a much-loved shopkeeper who has worked hard all his life.”
Detective Superintendent Mick Gradwell, of Lancashire police, who is leading the investigation, said: “Police and an ambulance attended the scene and found the driver and passenger windows of the Focus smashed. Liam Kilroe was dead by the car and another man was in the car with stabbing injuries to his head and back.
“There had clearly been a struggle between the two men and we have recovered a knife which I believe to be Liam Kilroe’s. We have had a number of consistent accounts from eye witnesses to the incident and further inquiries will be made.”
A spokesman for Lancashire police said that the Crown Prosecution Service had asked them not to divulge details of the struggle because they would form the basis of their decision whether or not to prosecute Mr Singh. He said: “A file will shortly be passed to the Crown Prosecution Service for them to make a decision on finalising the case. Depending on their decision there will either be a charge or no further criminal action and the incident will be passed to the coroner.”

I CHEERED when I heard an armed robber had accidentally killed himself, he got exactly what he deserved! If the law tries to prosecute Tony Singh then they are as bad if not worse than the criminals of this country. I cannot believe they are even considering it! Tony Singh should be knighted not prosecuted.

We must be allowed to defend ourselves especially in an unprovoked attack ,we have for too long accepted the situation of victim with no come back . I am a woman and would defend myself as best I could under similar circumstances ,it is unfortunate if the final outcome results in the death of the attacker. No one would want this , as the surviver still has to try and get on with his life with the weight of this on his mind for the rest of his life, and this is the predicament that you can find yourself in following such an attack through no fault of your own and indeed as a law abiding citizen no doubt Mr. Singh finds this to be the case at present. Take heart Mr. Singh there are million who understand support your reaction ,I offer you my support and understanding in this awful situation you find yourself in.

It is important to accept that money is not more important than someone's life. Definitely, if the robber was in such a dire need of money, tony should have offered him money without turning violent, even if the robber does so. Since to punish him for this act of robbery is the work of the police, not of civilians. At least that is the Gandhian wisedom.

I never thought I'd be the one to suggest that we, as a nation, should take a leaf out of our transatlantic cousin's book! For instance if, in the States, someone threatens your life (in any capacity) and they die as a result, then this fact is positively celebrated by the police, locals and all law abiding citizens!

The government is right to charge Mr. Singh. The governments true, and real function is to grow it self, ever larger. Now that Mr. Kilroe is dead, who will generate crimes, feral children by multiple women? Think of all the police, clerks, welfare, housing staff that have their jobs threatened? They depend upon the scum like Kilroe to lay their government golden eggs. Less crime, less jobs. What are these people supposed to do?
Yes, Mr. Sing has done his worst. He has removed a fine, young productive member of the welfare state( Englandâs largest industry ). And, for that, he must be punished. Taxpayers getting ideas that they are running the show, must be nipped in the bud. Otherwise the whole foundation of the modern welfare state could collapse, producing anarchy in government agencies.

Here in North Carolina the cop's would be engraving a plaque for the survivor and congratulating him for taking a dangerous knife weilding parasite from our world. Of course here the shopkeeper would not have to fight the guy hand to hand: You can carry a handgun openly in a holster legally, and concealed is a short course and an automatic permit. You can buy as many guns as you can afford..
If you are a gun enthusiast, you can apply for a Federal license for a silencer, machine gun, sawed off shotgun, grenades, dynamite, etc. And guess what? These people account for ZERO gun crimes and they store their weapons properly against theft. And when a guy like the robber here shows up, dispatching him the to the infernal realms does not mean having to risk death and injury because only the bad guys are armed.
If that man os charged for anything, the UK might as well give up any pretense of being a free nation any more; better everyone has a gun than only the bad guys.

Tony Singh only had to defend himself because he was being attacked with a knife, if Liam Kilroe had not chosen to do this then he wouldn't be dead.
I hope that if I ever find myself in the same situation I would do the same in a second. All too often it goes the other way and the attacker is never found and another victim dies in the gutter.
Give a bravery medal to Tony Singh - he has probably saved future lives of victims and taxpayers money on the next jail term / court costs etc that this career criminal would have encountered on his chosen path of an easy, nasty life.

The CPS - you may have noticed that whenever there is an high profile case ( cash for honours) the stock reply is "not enough evidence to convict". I am confident that the Police will carry out a thourough investigation into the Robbery committed by Kiroe and conclude that REASONABLE FORCE was used by Mr Singh in defence of his own life this case.
There should be no need therefore to investigate any murder!

Reality? Tony Singh will lose his business due to having to spend 4 months on remand... then be acquitted and paid a six or seven figure sum out of the public purse to compensate him, when I'm sure all he wants is to go back to work soonest.

Well, here we go again - as expected!
For all the governments fine words about changing the law to protect the innocent victims who defend themselves against violent criminals we are now looking at a prosecution of someone who is almost certanly entirely innocent.
The law change should be simple. Anyone who is attacked or threatened by anyone using a weapon - of any kind - should be able to respond as though their attacker intends to kill them. The mere use, or threat of using a weapon, should be sufficient and no other consideration as to proportinality of response should be required. In practice this would mean that an immediate lethal response could be mounted without worrying about the legal consequenses later.
If the law were changed this way then violent attacks with weapons would almost disappear.
Kilroe had previous convictions for violence with knives. If his first victim had killed him - lawfully - we would not be having this discussion!

Or does 'self defence' not apply against career criminals armed with knives and in the act of committing their latest robbery.
Another question is why are career criminals always out on bail, whereas apparently there's space in prison for parents whose kids play truant, for example?

Reasonable force, minimum force, call it what you will. Having resisted an attempt at theft Mr Singh became fearful for his life in the subsequent struggle. The law is clear, he was entitled to do whatever he believed necessary to save himself.
One hopes that the CPS's deliberations will just be procedural and will not seriously consider prosecution.
We really need legal support for the principle that armed robbers hoist by their own petard have no come-back on their intended victims.

Mr Singh is a victim of crime, not a criminal. If the criminal justice system had done its job correctly and protected society from criminals like Mr Kilroe, Mr Singh would not have found himself in the position where he was forced to defend himself. It is time that the criminal justice system remembered its function which was so clearly illustrated by the former Lord Chief Justice Denning in so many of his rulings.
Alternatively, perhaps we need a law which would clearly allow the public 'the right to defend oneself from an imminent act of harm' as defined in the Castle Law in Texas. The law needs to move away from protecting the rights of criminals to offend.

There should be no case to answer, a career criminal with no morals ,and who should not have been free to commit further crimes , has been stopped in his tracks by someone courageous/angry enough to fight back. The story would probably have attracted less interest had Mr. Singh been the victim. Let Mr Singh return to work and contribute to his community without having to worry.

Everybody likes a hero, no one (myself included) likes being threatened, being made frightened and then robbed. For men especially, this is a deep blow to our character. Hollywood makes money by portraying the hero that fights back - it's very romantic. So it's no surprise that Mr Singh gets all these plaudits - and quite possibly they are well deserved.
However, there is another scenario. Maybe the thief, upon being challenged dropped the knife. Maybe (and it's only a maybe), Mr Singh, so outraged at the attack, decided to be judge and jury and stabbed him AFTER Kilroe had ceased his attack.
It is the duty of the police to investigate ALL possibilities. It is not the duty of the population to be avenging angels.

I to would like to hope the police are just following the necessary procedure to protect the rights of Mr Kilroe or any other person.
Of course Mr Singh should obviously be exonerated as expediently as possible. He should additionally be compensated out of public funds and the estate of Mr Kilroe for any loss he suffers through no fault of his own.
It is however important that the police uphold the law rather than administer it, even though at first sight the conclusion seems obvious. Let us hope the CPS deal with this incident quickly.

Let's hope the CPS is just following some sort of bureaucratic procedure handed to it by our leftist government, and that Mr Singh will be able to sleep soundly soon. I would much prefer Lancashire Police avoid the "just the facts" approach and openly congratulate Mr Singh on a) being alive to read this article, b) defending himself against an armed attacker and c) removing a menace from society. Perhaps Mr Kilroe's next victim would not have been so skillful at protecting him- or herself.
Even the suggestion of prosecution undermines the right to defend oneself. Once someone attacks you with a knife they should lose all rights. If you don't want to die don't threaten to kill people.
I admire you Mr Singh. I'm sorry you've been put in a situation where you were forced to take a life, as I'm sure you are, but without your actions those close to you, and probably other families in the future, would be mourning.

When this case goes to court and the case fails as it inevitably will the individuals responsible for bringing this case at the CPS should be made personally liable for the costs of the case. The Bill of Rights give a person the right defend their property, there is is no limit within that bill as to the actions that can be taken to defend their property, if the police are denying an individual their constitutional rights under the law then technically that amounts to treason. A nice little counter prosecution against the police and CPS would see the charges dropped faster than you can say "End of career."
