Three police officers are being investigated after a soldier claimed he was repeatedly beaten while being pinned to the ground.
CCTV footage shows Lance Corporal Mark Aspinall, who was praised for his bravery against the Taleban in Afghanistan earlier this year, being held down by two officers while a third appears to hit him on the back.
Mr Aspinall, 24, was later found guilty of of assaulting the police offices but the convictions have been quashed on appeal after a judge watched a video of the incident.
The nine-minute video, obtained by the Sunday Mirror, shows a drunken Mr Aspinall gesticulating at three police officers in Wigan, Lancashire, in July.
It is claimed that he was mistakenly identified by the officers who had been called to deal with a man causing a nuisance to paramedics in the centre of the town.
Mr Aspinall is then seen tripping as he attempts to run away from the police and then is then held down by three officers in fluorescent yellow jackets.
An officer, identified in court as PC Peter Lightfoot, appears to twice push Mr Aspinall’s head on the ground in the middle of the road.
Two colleagues - PC Richard Kelsall and another named only as Sergeant Russell - pin down his legs.
When Mr Aspinall bites one of the officers legs, PC Lightfoot appears to scrape his face on the road. He then hits Mr Aspinall eight times on the back before he is put in the back of a police van.
Mr Aspinall was convicted of two counts of assault by Wigan magistrates after the three officers read statements that he had been “behaving violently” and “issuing challenges”.
He was given a three-month suspended prison sentence, ordered to serve 200 hours community service and told the pay the officers £250 compensation.
But the conviction was overturned after the video was shown at an appeal hearing at Liverpool Crown Court.

This to me is a very good reason to review the situation of speicial costables. The introduction of commuity police officers is also questionable and like spiecials only serves to dilute further the already poor professionalism of the police.

I assume that there is freedom of speech in the UK as in the USA, so what's the constables problem? Why did they bash his head against the ground? They are not their to convict and punish, but to arrest those in need, not just verbally saying un-pleasantries to them.

If this 'war hero' had maybe stood his ground and and explained to the officers that he wasn't who they were looking for, and not drunkenly verbally abused them and tried to run off, this situation could have been averted.

It is a shame the Magistrates dealing with the case against Mr Aspinall were not shown the CCTV footage of his arrest. Why did his defence solictor produce it at the CC appeal and not at his trial in Mags court who then would no doubt have thrown the case out and questioned the arresting officers

I am an emergency worker. I despise the police wth a passion. They are little more than licensed thugs and I have greater respect for pub doormen. The police can no longer be trusted, and I hold them in the same contempt as other organised violent gangs. What happened here is the norm.

15 years ago I suffered the same fate at the hands of our police, since that day I've hated the police and have not cooperated with them in anyway, despite my father being an officer who died in the line of duty and me now being a respectable middle aged businessman.

I agree if you are seen to be drunk and abusive to police you cannot complain when locked up.But i also agree that banging/rubbing/pushing some bodies head with 20 stone of force while unable to move as very agressive,this has to stop.

Mr Aspinall is fortunate the tape came to light. In a similar situation I was unlawfully assaulted by police, receiving a dislocated shoulder, broken nose, broken fingers, two black eyes and cuts and grazes all over. Upshot? I was charged with assault and received 2yrs suspended sentence, £1500 fine

As a retired policeman I am disgusted with the treatment of Mr Aspinall. I read from press reports that the incident was being investigated by the IPCC. I sincerely hope that Mr Aspinal has his day in court appearing as the witness in an assault case

I have always had the upmost respect for the Police and the work they do but incidents such as this highlight the serious issues the UK faces today. Although the man had been drinking, it is not a crime to do so and the actions of the officers is nothing less than gross excessive force.

No. But don't hold your breath anyone will be charged never mind found guilty. You'll note they haven't even been suspended! That, I think sums up the ethics of GMP.

Precisely why I left the uk... the British police are behaving more like violent criminals daily......they traditionally abuse their powers under color of authority........they are a disgrace to law enforcement and need to be dealt with by our off duty military, etc

The use of excessive force by the police officers should be looked at, however, police deal with drunken louts on a daily basis and many times officers are injured in the course of their duty. Magistrates convicted on the evidence in front of them. If this man is a good citizen why was he so drunk?

A similar thing happened to a friend of mine but unfortunately for him the CCTV footage "went missing". This is by no means an isolated case.

The video shows a man making threatening gestures in a street full of people. Three officers tackle him. If a Tasar had been avaailable , it would have needed only one. Instead they have to use manual handling, which as anyone who has tried it knows, looks very violent and doesnt work.

we the general public have to abide by a code of what is "reasonable force" when dealing with say an intruder into our homes - should I take my guide about what is considered "reasonable" from the police? He may have been drunk but is this reasonable force for three policemen to use against someone?

Being one who would always back our police in their daily struggle with criminals etc I am horrified at what I have just witnessed, I cannot for the life of me, see how these officers can get away with such an overreaction. This was GBH and should not go unpunished.

The police have a sorry history of thuggery against those unable to defend themselves. Remember the assult on the drunk outside the nightclub, earlier this year, also caught on CCTV, and also where the police claimed he attacked them? Can't we get a Serpico to deal with thugs in uniforrms?

Not only was this chap drunkenly swearing at police officers (offence #1), he then ran off from them and proceeded to fight with them on the floor (offence #2) and then decides its a good idea to bite one of them (offence #3) whilst resisting being arrested (offence #4).

I hope the investigation into this matter examines whether the two colleagues of the puncher reported this incident to their superiors. If not, appropriate action should be taken.

This is standard, if you have been drinking then you are guilty, this is how the police deal with you... been here a few times but what can you say... they simply say you resisted and thats why you sustained the injuries.

Despite his horrific ordeal, Mr.Aspinall is lucky that this footage was finally 'discovered'. Why did it take so long? Why was this not presented at his trial?
I do wonder if Mr.Aspinall had been a Black or Asian youth, would this have ever come to light?

I do not understand how this story is turned around. One man is drunk and starts to abuse the police. He is then arrested but refuses arrest (this is clearly seen). While he refuses to be arrested, he bites and injures one officer. The officers HAVE TO use such force! Police has to be RESPECTED!!!
