The brother of a Bangladeshi waiter murdered in Orkney 14 years ago is demanding an inquiry into why it took Northern Constabulary so long to bring his killer to justice.
Abul Mahmud Shaffudin has voiced his family’s frustration that the soldier convicted last week of shooting his brother Shamsuddin Mahmood in 1994 was free for such a long time.
Mahmood, 26, was working as a waiter at the Mumutaz restaurant in Kirkwall when Michael Ross walked up to him and shot him in the head at point-blank range.
Ross, who was 15 at the time and wearing a balaclava when he killed Mahmood, had been seen in similar clothing carrying out military-style manoeuvres in the nearby Papdale Woods two weeks before the murder. He was also spotted arguing with Mahmood outside the restaurant.
Three years later he was named by police officers as the prime suspect in the killing during the trial of his father Edmund Ross, a serving police officer, who was jailed for four years for attempting to defeat the ends of justice in relation to the case.
His son, a former Black Watch sniper who has served in Iraq and was praised for his bravery when his unit was hit by suicide bombers in 2005, was also known to be a racist, telling fellow army cadets on once occasion: “Blacks should be shot.”
At the High Court in Glasgow last week Ross, 29, was found guilty of murdering Mahmood after after a six-week trial. Ross tried to escape from the court after the verdict was read out but was wrestled to the ground by a court official and recaptured.
Speaking from his home in Bangladesh, Shaffudin, a 63-year-old lawyer, said he was relieved the family’s ordeal was finally over, but that many questions remained unanswered.
“We were convinced long before the trial started that Michael Ross was the person who killed my brother. We have known for many years,” he said.
“We were feeling frustrated and asking, ‘Why is this taking such a long time, why is there no progress in the investigation?’
“ It’s been an inordinate delay for this to come to trial. We would like to see it investigated.
“I appreciate there was a delay because Ross’s father was trying to pervert the course of justice but that shouldn’t have held this inquiry back so many years.
