Pakistan’s top judge is expected to launch a bold attempt to thwart President Musharraf’s quest for a new five-year term in office after being reinstated by the Supreme Court.
In an historic ruling yesterday the court annulled General Musharraf’s decision to suspend Chief Justice Iftikhar Muhammad Chaudhry. The 13-member bench also quashed charges of corruption and misconduct against him.
The ruling, the first time in Pakistan’s history that the superior judiciary has stood up to a military ruler, prompted celebrations by thousands of Chief Justice Chaudhry’s supporters. It dealt a serious blow to the authority of General Musharraf at a time of extraordinary turmoil across the country. The verdict is likely to embolden pro-democracy activists calling for the general’s removal.
There is mounting criticism of his Government for its handling of the Chaudhry affair and for its inability to contain a wave of suicide bombings that have brought bloody mayhem from the lawless tribal areas to the heart of Islamabad, the capital.
Yesterday Washington welcomed the Supreme Court decision. But there is likely to be concern in the White House that Chief Justice Chaudhry’s reinstatement could hasten the departure of General Musharraf, who has been a key ally in the US-led War on Terror since 9/11. Reinstated by ten votes to three, Chief Justice Chaudhry is expected to challenge General Musharraf’s plan to remain as head of the army while standing as a candidate in presidential elections that are due to take place in October.
General Musharraf has denied that Chief Justice Chaudhry was suspended for political reasons. Officials say that the judge misused his office and received favours. The claims have been dismissed by Chief Justice Chaudhry’s supporters, including senior members of the Pakistani judiciary.
Justice Khalil Ur Rehman Ramday, the most senior Supreme Court judge, said that the suspension of the Chief Justice was in direct conflict with the Constitution. Hundreds of lawyers and political activists who had thronged the court compound greeted the judgment with anti-government slogans. “Go Musharraf, go,” they chanted. “It is victory for the entire nation,” declared Munir Malik, the president of the Pakistan Bar Association.
Shaukat Aziz, the Prime Minister, said that his Government would accept the ruling and appealed for national unity: “We must all accept the verdict with grace and dignity reflective of a mature nation.”
Asma Jahangir, chairwoman of the Human Rights Commission of Pakistan, said: “It’s very clear that guns and intimidation will not bow down civil society or civil institutions of Pakistan.”
Chief Justice Chaudhry had become the focus of opposition to the President since his controversial removal from office on March 9. As he was mobbed by wellwishers yesterday, he said: “Thank you. Pray for me.”

We all are saying "for the first time in Pakistan History such a decision being made" my dear fellow for the first time in Pakistan history such a leader we have" pervaiz musharraf" if he wanted could have blocked the verdict or had delivered the verdict of his choice. But infact he had put Pakistan Judiciciary on the right path after 60 years. We should all respect to him and support him for his role to put Pakistan in the right path.
Now it is the responsibility of Judiciary to keep themselves away from politics and make their judgment solely on merit.
Whether it has to do with mr. musharraf re-election as well, since we do not have any other leader (clean with any sort of corruption) except mr. musharraf.

This is a major victory for the forces struggling for establishment of rule of the law in Pakistan. After a long time there can be hope that fundamental rights enshrined in the much abused constitution will be restored in letter and spirit. This may not happen overnight, but the legal fraternity who championed the cause for independence of judiciary, and the civil society seem to be determined to settle for nothing less. Pakistan may be entering an era of genuine democracy committed to the ideal of social welfare in place the doctrine of national security imposed by the military rulers of the country. This may be the only course which can lead to political stability as well as peace within and peace without.

Pakistan has twice elected a female Prime Minister.
The national assembly has 72 out of 346 women members.
The senate has 18 out of 100.
The Air Force has women pilots.
The recent extreme restraint by the army at Lal Masjid was motivated by respect for women and children.
The judiciary has just proved it is independent of the executive.
Lets hope that The US and Canada can emulate this track record soon.

This is a magnificent day for Pakistan, after so many problems and dashed hopes. It is a major boon to those Pakistanis, and it may surprise the West to know they form the overwhelming majority, who passionately believe that democracy and the rule of law are the only guarantors of Pakistan's development and prosperity. Now the generals should return to barracks and be accountable to a civilian government elected freely by all Pakistan's citizens. The cure to extremism is proper representation and justice for all Pakistan's many disparate minorities, not the army acting as judge, jury and executioner. Finally, Pakistanis must recognise real heroes are not people willing to blow themselves and murder others but calm men like the chief justice who steadfastly resist pressure and win over others through shear force of argument.

Musharraf has lost all legitimacy to continue as the President of Pakistan after the Supreme Court's verdict. The longer he remains in office, the greater will be the damage to the interests of Pakistan. He had initially imposed his "election" as President by resorting to dubious means and corrupt electoral practices, and was trying to find ways and means to get himself "re-elected" for another 5-year term. The attempt to suspend and remove the Chief Justice was an important part of his re-election "strategy", but this back-fired and the "Emperor" was caught red handed in the game.
There is NO MORAL justification now left for him to continue as President even a minute longer, and he must go.
Hats off to the strategy devised by his legal team. That a "suspended" Chief Justice should appear as a litigant before his own court and secure a favorable verdict was unprecedented, but then "Man proposes, God disposes."

General Musharrafâs decision to suspend Chief Justice Iftikhar Muhammad Chaudhry has backfired. As these military rulers have always been bullying Judges to get verdict in their favour, General Musharraf never thought that this judge, known as Justice Iftikhar Chaudhry, will say no to him. He must have had shock of his life when Justice Iftikhar refused to succumb to his and his general's threats.
This is a landmark and unique judgement and will be remembered in annals of the supreme court as a bold judgement against the powerful establishment.
General Musharraf should now devise an exit strategy so that he is not thrown out with further humiliation and disgrace from the public and its supporting judiciary.
I will liken Justice Iftikhar Chaudhry as Robin Hood of Pakistan.

The bedrock of a civilized society is an impartial and fair judiciary. In Pakistan, the judiciary fro ground up is corrupt and can be easily bought. This seems to have been conveniently forgotten whilst focusing on this case.

He must also face trail for committing high treason for overthrowing an elected government of Mian Nawaz Sharif in 19999. Since he came to power by unconstitutional means, all his acts including appointments of the non-academic Vice-chancellors of the universities, should be declared void
