The parents of Madeleine McCann may set up a separate fighting fund to pay mounting legal costs as they seek to defend themselves against accusations they were involved in her death.
Kate and Gerry McCann have appointed top lawyers in Portugal and Britain after being named as formal suspects in their daughter’s disappearance.
They have said that they will not use the fund set up to find Madeleine, which now has more than £1 million in it, but a family source told Times Online today that setting up a new fund “was one of the options they may well look at”.
Mr and Mrs McCann are being advised by Michael Caplan, QC, and Angus McBride, from the London law firm Kingsley Napley. Mr Caplan acted for General Augusto Pinochet when Spain tried to extradite the former Chilean dictator from the UK in 1999.
The family source said: “I don’t know [what they are going to do]; that is one of the routes they can go down. Money is going to be a big problem I think. PR firms and law firms are not cheap and it is clear the fund will not be for legal advice but that is the least of their worries now."
On Friday a family friend, David Hughes, said that the fund was looking into whether it could by law pay for the couple’s defence but today he confirmed that Mr and Mrs McCann would not apply for money from the fund.
Outside the family home in the village of Rothley in Leicestershire, he said: “Gerry and Kate’s view is that if they take money from the fund, it might be that 90 per cent of people who made donations aren’t bothered about it. But if 10 per cent of people are bothered about it, they don’t want to upset them. They want to take the controversy out of the situation.”
Donations totalling £1,036,104.17 have so far been received for Madeleine’s Fund: Leaving No Stone Unturned, according to the official campaign website. The fund, which for legal reasons is not a charity, has four objectives, one of which is “to provide support, including financial assistance, to Madeleine’s family”.
It could take a judge in Portugal several weeks to go through the ten lever-arch police files about the case. Jose Cunha de Magalhaes e Meneses, a public prosecutor based in Portimao in the Algarve, yesterday ordered the 4,000 pages to go before the criminal instructional judge.
The judge has a number of options, including ordering Mr and Mrs McCann to return to the Algarve to be placed under house arrest, or to attend more police questioning. He could also authorise further searches and approve further phone bugs. He has ten days before he must make a ruling on which options, if any, are appropriate.
The prosecutor has applied for the judge to validate retrospectively the seizure of diaries and correspondence belonging to the McCanns, a Portuguese newspaper reported today. Although the documents are already in the hands of the authorities, it is the judge’s duty to ensure that the investigation “respects the rights, freedoms and guarantees of the arguidos [official suspects], avoiding abusive interference in their private lives”, according to the Jornal de Noticias.
The paper did not specify whose diaries they were, but Mrs McCann has frequently been seen writing her diary since Madeleine went missing.
Police intend to seize some of Madeleine’s toys for analysis, another paper reported today. Among them will be her favourite stuffed animal, Cuddle Cat, which Mrs McCann has been seen clutching almost continuously since her daughter went missing, the Diario de Noticias said.
Mr Hughes could not confirm either of these claims, but said he believed that Cuddle Cat had already undergone forensic testing.
Detectives are convinced that Mrs McCann was in some way linked to the accidental death of her daughter, and that she and her husband then disposed of the body.
Hair and bodily fluids have been found in the boot of the car that the McCanns hired shortly before visiting the Pope at the Vatican. Police have said that the amount of hair in the Renault Scenic is too much simply to have been transferred on Madeleine’s clothing and other belongings when the couple moved to a villa in the resort.
One trace of bodily fluids has an 88 per cent match with the child, rather than the 100 per cent match that was previously reported, detectives said in an off-the-record briefing on Monday night. They denied that blood traces had been found.
The McCanns, both 39-year-old doctors, vehemently deny any involvement in the death. They fear that they are being framed by police and that evidence is being planted.
Portuguese newspapers have suggested Mrs McCann could face charges of homicide by negligence and concealing Madeleine’s corpse.
If the prosecutor makes a request - for example, to bring charges or impose stricter bail conditions on the McCanns - the judge has ten days to decide whether to agree to it.
Mr McCann’s sister, Philomena McCann, said the handing of the files to the judge changed nothing as far as her family was concerned. She added: “If they bring charges against Kate and Gerry, that will give them a chance to clear their name. It will give us a chance to end all this speculation.”
Mr McCann used his blog on the official Find Madeleine website to assert yesterday that he was “100 per cent confident” his wife was innocent and to speak of the “unending nightmare” of the past week.
He wrote: “We always hoped that we would not have to return without Madeleine and could never have imagined the possibility that we would do so as suspects in our own daughter’s disappearance. The pain and turmoil we have experienced in this last week is totally beyond description. Kate and I are totally 100 per cent confident in each other’s innocence, and our family and friends have rallied round unflinchingly to support us.”
Police are planning fresh searches in the Algarve resort of Praia da Luz, where Madeleine went missing 132 days ago, including digging around the village church of Nossa Senhora da Luz, according to the Diario de Noticias newspaper.
Chief Inspector Olegario de Sousa refused to confirm or deny the report, and there was no sign of searches at the church today.
Fernando Jose Pinto Monterio, Portugal's attorney general, announced last night that he was appointing a second public prosecutor to the case, the Lusa news agency reported. Luis Bilro Verao will work with Mr Cunha de Magalhaes e Meneses.

All i have to say is that there is something very strange going on here. We live in the year 2007 and are up to date with the latest technology, yet they are not able to find anything? Either the parents are genius and will go down in history as the oscar winning psychopaths or Portugal will have to change its name and move somewhere else in the world! Its all a bit ridiculous.

Innocent or guilt, all angles should be taken into consideration. In this day and age, is it that impossible to have been a mother or father to kill their own child? Had it been a portuguese couple in th UK, would that make them better suspects? If the investigation proves them innocent, then all the better. However if the investigation proves them guilty, then what are we supposed to do? Declare war on Portugal and declare the UKs' justice the only true justice in the world? Proclaim the McCanns saints? The only fact I know for sure in all this is that the children should have had a babysitter or been taken along with the parents, all the rest is pure speculation at this point.

I think that setting up a separate fighting fund would be a sound idea. I would be happy to give a contribution. I think that there would be a severe backlash from members of the public if the money from the existing fund was used for anything other than trying to find Madeleine. This is a forensic led investigation assisted by the British police. I fear we may never know the truth of what happend to Madeleine. It must be so unbearable for the McCanns if they are innocent. They have courted the media, encouraged high profile events and must now bear the scrutiny. Innocent until proven guilty.

I think it would be inappropriate for them to use the money in the madeline fund to pay for PR and Legal Representation. The purpose of the fund was to help find Madeline. This has been an extremely high profile case and I don't think it fair that the McCann's should be able to seek funding for PR and Legal Representation because of this, playing on the public sympathy. What right should they have to better representation than any other parents in the same situation? If it's as clear cut that they are 100% innocent even a basic lawyer should be able to help them. As for needing PR, well that's another issue in itself. Most people who need PR find themselves in a bad situation of their own doing and want to put a positive spin on things for their greater good. I personally don't think it's an honest approach. PR, Spin, leave that to the politicians and pop stars.

It's very difficult to have an objective opinion on this case at the moment with so many different rumours but what I understand is that the police investigating the case think that madeleine was accidently killed by her parents and then they have covered up this fact and somehow managed to hide her body for nearly a month before moving her in the hire car. Now knowing that they were both Doctors, I find it difficult to believe that if they found there daughter dead, they wouldn't have instead summoned the emergency services and started trying to resuscitate their daughter using CPR techniques straight away and surely by doing this family friends and Hotel staff would have known something was wrong. I'm suspecting that any DNA they have found in the Hire car will turn out to belong to the McCanns' other Children or will be from something that belonged to Madeleine. However I'm not sure that people will feel comfortable donating to a legal fund in the current climate.

I donated to Find Madeleine and I'm more than happy for Gerry and Kate to use the money any way they choose. If the PJ are no longer looking for Madeleine then Kate and Gerry need to eliminate themselves from the inquiry so that the hunt and focus can return to Madeleine.I think most of the people complaining did not donate and just want another stick to beat the McCann family with.

It will be interesting if a fund was setup to assist with their legal fees to see how much they could raise. I think this step is immoral by mere fact that they are suspects and I hope there is a law preventing this. I am not assuming they are guilty or not guilty just that as they have been declared suspects it seems an unjust course of action if allowed. I hope for many reasons they are not involved in Madeleine's disappearance - there would be too many issues to cover, let alone the security the whole McCann brigade would need having led such a large campaign. The world (yes world) would feel cheated and the whole family would find themselves as outcasts. It doesn't bear thinking about. Indeed they would need a large legal fund to fight the voluminous potential cases of obatining money from the public by deception. I hope it doesn't turn out that way.

As doctors surely the McCanns have sufficient money to pay their legal costs . I don't understand why they need the public to donate money for this. If they are innocent - and I have tended to believe they are - why do they need such distinguished judges? Why can't they use solicitors etc. on the same level as the rest of us have to. I think her parents had more to do with it than there letting on. I have thought this all along because when she first went on T.V she was no where near as upset as you should be if that has just happened to your child. Her mum seems healthy and well if that happened to your child you would be constantly crying and ill from not eating through worry. I think they have done it and soon we will see.

They are a very selfish couple to leave three young children unattended whilst they "enjoy" a night out. This same SELFISH couple would probally not want to risk losing their lavish lifestyle by confessing to accidentally killing their child so probally did try to conceal the death.

These 2 really are quite dillusional. First of all they leave 3 little children alone, if that's not bad enough one goes missing and they set up a fund to 'find her'. When they know that that won't work they are now trying to set up a fund to keep them living in the style they've become accumstomed. I know that this may not be very palatable for the British public because most people including the McCanns, think that it will never happen to them.
Why don't we have a proper legal fund? We ddi have one. It was called Legal Aid but generally only thought to be used by the oiks!
Now, with the 'advances' in DNA recognition as Lord Justice Sedley said that should mean everbody's DNA kept on file with nobody (regardless of money etc) being able to avoid this, we won't have any 'accidents' in recognition will we?

The world is looking at the McCann's with great scrutiny. To even consider using the fund for McCann legal/PR fees--when its original intent was to FIND MADELIENE-- is, at a minimum, a PR faux pas --and at its worst, lacking in clear judgment. Desperation clouds good judgment. I hope the new fund isn't simply a different pot into which these funds will be quietly diverted and I pray the McCann's have ethically-sound counsel as it relates to these matters. They've been through a lot and I am sure the worst is not yet upon them. This will be a marathon and not a sprint. If they need to offer their home for sale to defend themselves than I suggest they do so. There are worst things--think of what Madeleine has had to give up. Should the McCann's be any less heroic?

The Portugese police are obviously trying to find a scape goat and should be ashamed of themselves. Portuguese law certainly seems to rest on very unsolid ground. I for one will never visit Portugal again. It is horryfying what the McCanns are going through. First they loose their daughter and then the local police is so incompetent that they cannot carry through a decent investigation. To search a car for Madeleines DNA, when the car has been used to move her things ? it is impossible for me to find words to describe such nonsense. To my knowledge their is no way to say if DNA comes from blood or other remnants. This is a joke. I hope a lot of people will contribute to a fund to pay the costs for legal help.

Claire's idea of justice strikes me as a very strange one. She appears to have already decided that the McCanns are innocent. Unless she is in possession of the evidence that the police have, I don't see how she can be sure of this position.

I agree with the Professor. The McCann's are victims of a terrible crime and I cannot imagine the anguish they are experiencing. I would contribute to a fund to help them clear their names. All this is diverting the attention away from the search for Madeleine. This family needs to find their daughter, whether she is alive or dead, so they can either get back to their normal family life with Madeleine or grieve in peace and start to rebuild their lives again without her. I do hope there is a happy ending to all this soon.

I agree that the most obvious culprit is the person who rented the car from May 3rd up to the date the McCann's rented it. Therefore, not the McCann's. I also don't understand how all these folders can have been given to the Judge for a decision, when a lot of the forensics are still being worked on in Birmingham - the Portugese Police haven't got the whole forensic picture yet.

I find it hard to comprehend how the Mc Canns who were under intense media attention were allegedley supposed to put the body of their child into the boot of the hire car without being noticed. Extremely coincidental that they were made formal suspects a few day's before they should have returned to the UK, this was merely a tactic to prevent them from talking about the the investigation which portuguese authorities made a complete hash of.

Is it my imagination or do things seem a little one sided at the moment? The Portugese Police "sources" seem to have been leaking like a sieve for the last week or so while the McCanns seem to be constrained to "we are innocent"...what happened to the so called secrecy of the Portugese justice system?
It seems to me that we should remember that none of the information currently being printed by the press has been tested in a court of law so it should all be be treated with the greatest scepticism.

Tragic accidents can and do happen (to everyone).
It is entirely possible that the McCanns were the victims of a terrible accident and then tried to cover it up. To me the question is not the likelihood of them having deliberately harmed their daughter but whether they might have been likely to try to cover up a terrible accident.
This is clearly what is bothering the portuguese police.
The people who want to pay money into a fund for them to cover their legal costs cannot possibly be sure of the facts, neither can the media. The only people who know what evidence they have are the portuguese police.
Surely giving money to the McCanns for their defence is deciding they are innocent of this without knowing all the facts or not caring and just wanting them to be free.

I find it disgusting that Kate and Gerry MCcann have to endure all this controversy from everyone as well as losing their daughter. Why on earth would both the MCcann`s keep Maddie`s disappearance in the spotlight for so long if they had been responsible for for Maddie going missing. I understand that where the McCanns' stayed in Portugal has a very small population and that the rental car company only has two or three card for rental...have the lawyers for the McCanns looked into the persons that might have rented this same car since Madeleine's disappearance?
The abductor could have rented the same car as the McCann's did, thus the reason for the hairs in the trunk of the card and other DNA present in this same car....It might just be a coincidence that the McCanns rented this same vehicle

many people seem to think that portuguese police is making all this just to find a solution to that...it's incredible. what interest would they have on doing this? back to the reality!!! it's like a movie. what they have found now isn't it enought to suspect kate and gerry? i'm not acusing but with a little good sense isn't it suspicious'? plus the portuguese police is working on this with bristish police an british labs, what is the most trusted police or parents who are responsable to look for the childrens, isn't right that they should be the first suspects when a child desapear from his own bedroom?

Have they (police) also found the DNA samples of little Maddy's other two sisters in the similar locations in that rental car? If yes, this means the finding of little Maddy's samples in that rental car is not very supportive to the police claims...!!!

It is important for the twins to have both of their parents around for them and therefore it is important for them to get proper legal representation to clear their names. A common sense approach would be to let the Portuguese police get on with their investigation and to reserve judgement and keep your hands in your pockets until more facts come to light. Will there be a "Libel Fund too.

As soon as the new legal fund is established, I will send all the money I can. I am in the 90% who has contributed to the Madeleine fund who would not mind at all if the parents used it for their legal defense. At this point it seems that clearing their names is going to be the only thing that can be done to find Madeleine, since the police are not going to look for her alive until the parents are cleared. I would encourage anyone who has sympathy for what these parents must be suffering to send any amount you can... even a few dollars can help tremendously if enough people send it!

At this point it is absurd and ignorant for any of us "spectators" to claim the innocence or guilt of the McCanns since we have absolutely no idea what evidence lies in the 4,000 page report.

Let's have a finish to the 'they did it / they couldn't possibly have done it' crowd online. Both are opinions voiced without adequate information and therefore are totally without merit. Can we not just have some respect for awful situation?
To take either position is an offense to intellect which gives me the greatest fear for what will happen next when either of these appalling possible outcomes come to pass; the McCann's are found guilty or they are found innocent; The former would be one of the biggest outcries of decades for deception. The latter an appalling strain on the family and a terrible waste of a search for the girl.

I would like to contribute to the legal fund as the evidence leaked by the Portugese Police seems unconvincing and the story of what Kate is supposed to have done is more incredible than most accounts of abduction by aliens. This poor family must be going through absolute hell and the way it has all been handled is all so very unprofessional.
They are faced with huge costs now to clear their name and I guess there are a lot of people who have retained some common sense and are sympathetic and would like to help.
