The man who hurled himself and his children off a hotel balcony in Crete, killing his son Liam, was today found not guilty of murder because he was deemed too psychologically unwell.
John Hogan, who remains on medication for his mental health problems, was sent to a psychiatric unit after his crime was found under local law to be "unpunishable" due to his mental state.
The jury of three men and a woman deliberated for just 40 minutes before reaching their verdict. Mr Hogan had denied charges of murder and attempted murder.
"His responsibility was diminished. He was incapable of murdering his son and he needs to be in a psychiatric unit for therapy," said President Paraskeri Kiraleou, who led the panel of three judges.
When the decision was announced, Mr Hogan broke down in tears and was heard to say: 'I'm innocent."
Meanwhile, at the other end of the court in the public gallery, his ex-wife Natasha wept and was comforted by Avon and Somerset Police liaison officers who had accompanied her on her trip to Crete.
Mr Hogan will begin to receive treatment in Athens, Greece, while the British and Greek authorities discuss his psychological care. He may then be allowed to return to the UK.
After the announcement was made, Dimitris Xiritakis, his lawyer, told reporters: "It is the right verdict. John Hogan is very happy with the verdict." Mr Xiritakis added: "Now they (his Greek carers) know him, he will remain in Athens while they discuss what to do. They cannot send him to prison."
However Mrs Hogan, who has since divorced her husband, condemned the decision, saying that her son had "lost his young life for nothing".
In a statement read out on her behalf, Mrs Hogan, 35, a nurse who now lives in Newport, Gwent, said: "I have done my best to provide a balanced view of John and our life together so that the Greek court is aware of the troubled times in both John’s life and our relationship together.
"This result, albeit somewhat unexpected, has left me feeling that Liam lost his young life for nothing."
Earlier, Mr Hogan gave his first ever public account of what happened when he jumped from the balcony two years ago. He sobbed throughout his testimony and repeatedly mumbled the word 'Sorry'.

John Hogan should be incarcerated in a secure facility for the criminally insane for the remainder of his sorry life. If he wanted to die, ok, he could do that. But not the children...not the babies!
Alix Kazan, Augusta, GA, USA
This story seems to be the works of great fiction but unfortunately it's all a blood boiling reality. Diminished responsibility is perhaps the most plausible state of mind Hogan was in at the point of leaping from the balcony but the tragedy of the son dying does seem to have been sidelined. The fact remains his mental state might have not been deemed sane but he was still the vehicle for his son's death. It's quite unbearable to read that he claims otherwise. A moment of madness and he's destroyed a family unit. Sorry to say he should be kept away from his daughter indefinitely.
You don't take out your failing marriage on your kids! And they were in the crossfire. Pathetic.
Arjun Chelley, Leicester, England
There was a very similar case here in Ireland. A woman ( a psychiatrist) drowned her 18 year old daughter who had anorexia. The woman was found not guilty due to Insanity. There was little or no criticism of the verdict .Indeed the jury was instructed to bring in the verdict. Is the differnce in reaction due to the sex of the perpetrator?
Kevin, Limerick, Ireland
I think the Greek jury showed common sense. The criticisms so far seem to be based on vengeance not justice. Claire Rayner wrote about this case just after it occured and she wrote a very good piece on this in the context of mental illness.Murder implies malice aforethought. As has been proved there was none.
SLC, Hants, U.K
Frank - what have the lawyers got to do with this? Are you seriously trying to say that lawyers would deliberately drag out a tragedy like this just to line their pockets. Shame on you!

We can only hope that his room in the mental hospital is on the top floor with a nice balcony....
When do you suppose his book will come out?

"presumably at tax payers' expense".
Good lord. All this happening and you want to whine about the burden to tax-payers for a couple of police. Extraordinary.
Mark, Worthing, UK
Good to see the right decision in this very tragic case. In the UK we tend to lock up the insane in prison. We just don't care for them in order to save money.
Paul Davis, York, uk
I bet we have not heard the last of John Hogan.
Cromwell, Leeds, England
Mr. Hogan knew he had mental health issues. By his own admission he quit taking his medication, then has a psychotic episode resulting in the death and injury of his children.
I've got no sympathy for this man. He should be in jail for manslaughter. According to his own words that are quoted in the article - "It was all my fault. I used to have panic attacks. Whatever you do to me in this court, no-one can do to me what I have already done to myself."
He'll be out of confined care in a couple of years, go off his meds again and kill someone else.
Michael, Los Angeles,
Read his comments - he is so guilty and I am assuming that the three judges could not speak english - that is why he got off !!"!
Ann, Worcester Park, UK
Tragic events full stop! however I cannot condone Mr Hogans actions, but his "ex" wife never appears to shed any tears only screws her face up in agony in an unconvincing way sadly her actions prior to the jump were indeed the catalyst to their problems sadly with the loss of a childs life
GLEN , Newcastle,
I'm sure there was guilt on both sides of the relationship. The press seem to like to portray one side as a pantomime villan and the other as the hero in any conflict. I thought her comment that "Liam died for nothing" was a bit odd though. Would it have been "for something" if her husband had gone to prison for 25 years?
Tragic all round. The state of mental health services in England is pretty awful. With so many people suffering from mental health problems better services should be provided. A GP told me that the waiting list for NHS psychiatry or psychotherapy was over a year in the South West! Doctors don't seem to get much training in the area either...
Paul, Bath,
It said in the article police officers (plural), why was this I wonder.
Jimmy James, Coventry, U/K
This is one lucky guy, first he survives jumping off a building, then gets away with murder, even his murdered son has forgiven him apparently. He'll probably get his own chat show next. There's no justice in justice these days.
Sedgwick Morrison, London,
If she'd been the one to kill the child she'd have got life ! Its a mans world .
MJS, yorkshire, UK
Just unbelivable a man can get away with murder like this, the world is to soft and forgiving of these people and we wonder why its so hard to keep law and order. I feel sorry for her faimly as they will have to live with this for a long time.
james, london, england
British lawyers would have spun this trial out for at least six weeks, ideally with a wrong result so that they could get second helpings on appeal..
Frank Upton, Solihull,
It was a nice freebee for the cop. A nice trip to Greece. Away from his desk and proper work. Of course we tax payers paid for it. Try getting them to do something about noisy neighbours or antisocial yobs and they tend to be too busy. I'm glad the defendent was found not guilty. He obviously acted the way he did because of a mental condition. Get well soon mate.
Nick Martin, London, U.K.
This is a very tragic event. I glad that Mr Hogan has been found not guilty, he was clearly unwell at the time. People with mental health problems like this are not criminals, they are ill and need to be helped and cared for. I understand that his ex wife is devastated by what has happened, but as a nurse should be able to realise that her then husband wasn't well. For her to say her son death was for nothing is ridiculous. We seem to live in culture that demand vengeance rather than justice. I am relieved that the Court delivered justice and did not give in to the mob.
Jon Berry, Glasgow,
Wow!
Interesting that the only criticism offered is about the mother.
Does Chris Palmer not think that it is quite possible that the whole family would have been better off if this man had decided to end his own life before ending the life of his son? Why is it that so many families are torn apart when the husband decided HE cannot take it any more. Why is it that this so often means that he doesn't want the rest of his INNOCENT family to live any longer and only once he has murdered them all can he find the courage to end his own worthless life.
I agree 100% with the Greek jury, this man certainly has severe mental health issues and he probably is so deranged that it would be unjust to convict him of murder. Let us hope that his "carers" don't decide that he has miraculously recovered now that he has ended one life, and scared two other human beings.
becky, Truro,
A good defence lawyer can conjure up anything to get a criminal off these days! This guy had a momentâs psycho-problem? What a load of old rubbish. He was simply a coward who couldnât take his own life but tried to take two others with him in his selfish attitude. He murdered his son. He was lucky or unlucky not to have murdered his daughter. And he survived his sucide attempt. Lock him up and throw away the key.
Nicolas Kozeschnik, London, United Kingdom
Ye Gods!
She must have really loved the guy a lot.
After all, she remarried less than a year after this incident took place.
Probably better off without her.
Chris Palmer, Southampton, England
This was a tragedy but could someone please tell me why Ms Hogan was accompanied by members of the local police force (presumably at tax payers' expense).
Is it more Health and Safety madness that has now seems to have a strangulation grip on the UK?
