The grieving father of a dead US soldier has won nearly $11 million (£5.2 million) in damages against a fundamentalist church that disrupts military funerals in the belief that the war in Iraq is a punishment for America’s tolerance of homosexuality.
Albert Snyder sued the Westboro Baptist Church for unspecified damages after members demonstrated at the funeral of his son, Marine Lance Corporal Matthew Snyder, who was killed in Iraq last year.
The federal jury awarded $2.9 million in compensation, then returned in the afternoon with further decisions to award $6 million in punitive damages for invasion of privacy, and $2 million for causing emotional distress.
Craig Trebilcock, Mr Snyder’s attorney, had urged jurors to fix an amount that sent a strong message: "Do not bring your circus of hate to Maryland again.”
The defence said that it planned to appeal, and one of the church’s leaders, Shirley Phelps-Roper, said that members would "absolutely" continue to picket funerals.
“Don’t you understand this was an act in futility?” said Ms Phelps-Roper.
Members of the church, which is based in Kansas, routinely picket funerals of military personnel killed in Iraq and Afghanistan, carrying signs such as “God hates fags” and “Thank God for dead soldiers".
They gave evidence that they were following their religious beliefs by spreading the message that soldiers are dying because America is too tolerant of homosexuality.
Their attorneys maintained that the burial was a public event, and that even abhorrent points of view are protected by the First Amendment, which guarantees freedom of speech and religion.
Mr Snyder claimed that the protests intruded upon what should have been a private ceremony and sullied his memory of the event.
Several states have passed laws regarding funeral protests, and Congress has passed a law prohibiting such protests at federal cemeteries. But the Maryland lawsuit is believed to be the first filed by the family of a fallen serviceman.
The church and three of its leaders - Fred Phelps and his two daughters, Ms Phelps-Roper and Rebekah Phelps-Davis, 46 - were found liable for invasion of privacy and intent to inflict emotional distress.
Mr Snyder sobbed when he heard the verdict, while members of the church greeted the news with tightlipped smiles.
The group says that it is confident the award will be overturned on appeal. Mr Phelps said: “Oh, it will take about five minutes to get that thing reversed.”
Earlier, church members staged a demonstration outside the federal courthouse. Mr Phelps held a sign reading “God is your enemy”, while Ms Phelps-Roper stood on an American flag and carried a sign that read “God hates fag enablers”. Members of the group sang “God Hates America" to the tune of “God Bless America”.
It was unclear whether the plaintiffs would be able to collect the damages awarded. Before the jury began deliberating the size of punitive damages, District Judge Richard Bennett noted that the size of the compensatory award “far exceeds the net worth of the defendants”, according to financial statements filed with the court.
Jonathan Katz, defending the church, said that it has about 75 members and is funded by tithing. He added that the assets of the church and the three defendants are less than a million dollars and that the compensatory award is about three times the defendants’ net worth, mainly in homes, cars and retirement accounts.
One of Mr Snyder’s attorneys, Sean Summers, said that he would tirelessly seek payment of the award. “We will chase them forever if it takes that long,” he said.

This is the kind of things that churns my guts inside out. There are countless of churches out there that use god's name in vain for their sake and when it's not them who is doing it, then those people are considered the devil. They have this fallacious idea that they are protected by God and so they can use inflammatory, denouncing, derogatory, demeaning words - all for the sake of the "words of God."
This is extremely sickening...come on, at the funeral? Where's their morale? If the so-called "words of God" commands its people to inflict emotional damage on a grieving father then "God" must have no mercy at all.

At last some sense at this outrageous group. While I agree everyone is entitled to their opinion, this behaviour can be likened to inciting racial hate which there is a very harsh penalty for. Good on the judge and I do hope they manage to get the monies that have been requested. My thoughts are with the family who had to suffer this protest.

This is so terrible and such a shame that 'Christianity' (using the term very loosely) is being portrayed in such a horrible manner. I am a Christian and while I don't agree with homosexuality I will still love them and treat them with respect. Also, the most important rule from the Bible, the one that Jesus claims is the most important is to love one another. I see no way of this being a loving and Christian thing. Once again a bunch of people twisting scripture and putting it as what 'God says". A person's funeral is no place to come and push these horrible views and the soldier's family should have the right to mourn the loss of their son in peace and privacy.

As a Christian I feel I have to respond and say that I find the views held and actions undertaken by the Westboro Baptist Church as abhorrent and totally at odds with Christ's message of love, tolerance , acceptence, forgiveness and non -judgementalism. Thankfully these people are in the minority amongst Christians but unfortunately they have big mouths and draw media attention and there is a danger that some people will assume all Christians hold similar views. I am disappointed that their sentence was so lenient.

I am not a christian but I agree with a lot of what Jesus had preached about mankind and the nature of all. But I also know that the Bible does not approve of Homosexuality either.
Still not an excuse for those religious nuts to protest a straight fallen soldiers funeral. Dealing with the loss of a love one is hard enough and when you add something like this it degrades the fall one, his family, and the christian community at large.
Maybe the most important thing for all religious people is to realize is that most of their religious book preach tolerance as one of the most important virtues.

Truly sad. As a Bible believing Christian, it is not the best thing according to the Creator and his will to be engaging in this kind of miserable and senseless conflicts full of hatred and pride. Often times religion itself makes some lose perspective and misunderstand the clear message and the mission we Christians have been asked to perform. The Lord will soon come because we all as humans have rejected our Creator and therefore we are destined to be dead forever; far from Him. That is the message. The harvest will be very soon. Turn onto the Creator before it's too late. Accept His plan for salvation (Jesus defeated death for us) .There is a battle, but this is not the way to fight it. Give your life to Jesus the Savior. I live in Kentucky, USA where I have witnessed one of these protests. Although, it never really got off the ground, because a biker gang stood up to them and told them on TV that if they came to the funeral and protested they would go home in body bags. While I do not support this, I am glad they were shut down. Christians stand for peace and tolerance and obviously these bible beaters are anything but Christians. It disugusts me that people would actually hide behind God and religion to further their own agendas. I am a Christian and it is not for me to judge other's sexual preferences. What do I care? I am on this earth to do God's work, and hate is NOT a Christian value! :)

A perfectly legal and reasonable suit against these people. It is not the fallen soldiers, nor their families, who are responsible for the 'tolerance of homosexuality' in the USA. What these fundamentalists have forgotten is that the exact same rights they claim for their religion and the protest are those which have be used against them by this family.
I sincerely hope that this award is not overturned on appeal, and that many more law suits in a similar vein follow it.

Your right to swing your fist stops when it hits my face. The Westboro Baptist Church should heed the message from Maryland. Everyone is entitled to their views no matter how 'far-out' they may seem to the mainstream. Good grief! Have any of this so called-church ever read the Bible?! I believe Jesus' words were 'love your neighbour as yourself'. Speaking as a Christian, I have little doubt that Fred Phelps and his hate-merchants are not Christians at all, but just bigots hiding behind a religious disguise.
