HM Revenue and Customs have confirmed they will mount a legal challenge to Leeds United chairman Ken Bates's buy-back of the club, after he formed a new company to save the League One side from administration.
The club's creditors narrowly accepted his 1p-in-the-pound offer last month. It was a decision that angered the Inland Revenue, who are owed £7.7 million by the club in unpaid taxes, and had until 4pm today to announce formal action. Their concern was shared by Yorkshire MPs Phil Willis, George Mudie and Colin Burgon, who met with then economic secretary to the Treasury Ed Balls and former Sports Minister Richard Caborn at Westminster to express their concerns at the buy-back deal.
The Yorkshire club raised their offer to the Revenue of £77,000 to £616,000 yesterday in a last-ditch attempt to avoid a legal challenge. With Bates fearing the club could slide into liquidation, the former Chelsea chairman increased his initial offer to 8p in the pound and also agreed to extend the period that an extra £5m would be paid to creditors if Leeds reached the Barclays Premier League within ten years.
Before today's announcement, Bates voiced his fears for the future of the Elland Road club: "From 4pm on Tuesday there'll either be a Leeds United or there won't. It's not about personalities, it's about Leeds United and the many people who support the club on and off the field. I've always been told Leeds city needs a successful football club, and I hope Wednesday can be the first step towards Leeds United being a successful team for the city of Leeds," he said.
The club's administrators KPMG have insist they have acted within the laws of insolvency. A spokesman confirmed they were now considering their options and were not in a position to comment. He said: "We've not had time to study the Inland Revenue's notification yet."
Meanwhile, Leeds fans reacted with dismay at the Inland Revenue's decision to launch a legal challenge. Matthew Knowles, of Leeds fanzine The Square Ball, said: "This is very worrying news. Many of us are not in the Ken Bates fan club, but we knew that this was the only deal in town to get the team ready for the start of next season. If the club folds or is unable to challenge for promotion because of this legal limbo the local MPs who pressed for this action will have to answer to their constituents. "This challenge is not in the best interests of Leeds fans or the promotion prospects of the club," he said.
The club issued a statement following the announcement: "We do not have all the details as yet and do have a number of options available to us. We remain confident of a positive outcome despite this disappointing news and will carry on with business as usual in the meantime."

Two questions: If your family fell into major financial trouble would you want to be screwed into the ground and then kicked by the Revenue?
I wonder how much tax and VAT LUFC, its players, staff, ground, caterers and so on have paid over the last 87 years? Must be quite a lot.
The Revenue cuts deals every day when debtors are clearly unable to pay their debts or have entered administration or worse. This reeks of politicians meddling for headline purposes one more time. I wonder if their own financial affairs would bear this much scrutiny

There is no doubt that on the face of it the offer did not add up. But why leave it so late. The only people this affects are the players and the fans, who have been buying season tickets in good faith. What happens to our monies now, are we entitled to a refund, if as Bates threatens their will be no club.

I hope the MP's are pleased with themselves. If Leeds does go under, I can't wait to see them explain their actions to the 500 staff who will be layed off and the millions of fans around the globe. I also think the IR have acted with pure spite. If this was their intentions, why didn't they take action sooner? At least then we might have had the slimmest of chances to getting this issue resolved before the new season starts. If this doesn't kill the club, it'll certainly kill our chances of protion next season,

The Revenue are fighting a no-win challenge though, and spending tax payers' money doing so. If they win, the club will fold and they will get nothing. If they lose, they'll go back to the 1p in the £1 offer initially proposed by Bates. If they don't like the law they should fight to change it, but KPMG and Leeds appear to have acted entirely within it so far.

The Inland revenue received some £14 million in tax's from Leeds United over the last 2 years I believe and how much have they received in-directly from people associated to the club, it we are not careful Leeds United will cease to exist, I know that a lot of our competitors would love this to happen but think about the loss of jobs for the region, I think it is touch and go as to whether Leeds United will survive this, if Bates refuses to pick up the wage bills while this appeal is carried out it will be all over and where will the Club and fans be then? Leeds United need a break, we have fallen from the dizzy heights now give us a chance to climb back up, we are not the first to go into administration and get rid of a large portion of our debt, we wont be the last, we are just the biggest to do it...I for one hope that we can survive this, if we don't I am lost to football, I wont go and support another team just for the sake of it.

Yes, Leeds United do have to pay taxes but you have to remember the fans, Ken Bates etc are suffering from the mistakes of past regimes'. Ken Bates offered 616,000 now and alot more later which is better than other bids from self-interested people.
Government policies are a joke! Leeds United followed the law and are facing winding up. Man Utd get a work permit for non-qualififying Andersen - no wonder the England Team never come close to winning anything!

the original deal was very strange- why should supposedly independant creditors back a purchase which appeared to give them less than was available from non Bates source? The IR are quite right to challenge this deal.
