Ken Bates, the Leeds United chairman, called for the Football League board to resign en masse after an independent tribunal upheld the 15-point penalty imposed at the start of the season.
Leeds claimed that the League acted unlawfully when docking the points as punishment for breaking competition rules on insolvency. However, an independent panel disagreed and criticised the Coca-Cola League One club for the length of time it had taken to bring the action. That fuelled Bates’s ire and he pointed the finger at Lord Mawhinney, the Football League chairman, as well as his fellow club chairmen, whom he accused of being governed by self-interest. “The Football League board and Lord Mawhinney should consider their position and possibly resign because the manner in which they have behaved is disgraceful,” Bates said.
Leeds were docked ten points for going into administration at the end of last season. They then accepted a further 15-point penalty for not exiting administration via a Company Voluntary Agreement (CVA), subject to an appeal to other League clubs. Not surprisingly, more than 75 per cent voted for the extra penalty. “There is more than one club who voted for the 15 points because it would handicap us,” Bates said. He added that he was looking forward to meeting Paul Scally, the Gillingham chairman, at the final match of the season tomorrow. Leeds are guaranteed a play-off place but Gillingham could be relegated. “Mr Scally was very mouthy when he went on Sky TV and said he had studied the facts very carefully,” Bates said.
The decision means that Swansea City are confirmed as champions. Had Leeds received the 15 points back they would have leapt from sixth to second, one point adrift of the Welsh club and pushing their Yorkshire rivals, Doncaster Rovers, out of an automatic promotion place. Roberto Martínez, the Swansea manager, had predicted “a massive war” if the Leeds appeal was successful.
However, Bates told anyone celebrating Leeds’s misfortune that he had a long memory and that other clubs would find themselves in the same predicament. Leeds effectively were damned because the Inland Revenue refused to accept the CVA because it was owed £7.7 million. However, Bates said: “We have been penalised by the Football League for adhering to their policy of paying all football creditors.”
Bournemouth, Rotherham United and Luton Town are also in administration and Bates claimed: “Two of them cannot complete a CVA because of the Inland Revenue. What’s the Football League going to do now?”
Leeds said they had no choice but to accept the 15-point penalty in August. “If we had not, the club would have been lost for ever,” a statement read.
Stephen Hornsby, a sports law expert with Davenport Lyons, said: “The League was entitled to kick them out. They said, ‘Here’s 15 points’ and Ken Bates said, ‘All right’, but then he went running off to court. In rugby union Richmond went bust during the season and were demoted nine divisions. If that is one end of the scale, then 15 points is the other.”

I feel disgusted by the decision to reject leeds appeal.
it is symptomatic of the double dealing in football at present.
West Ham received a pitiful 2.2 million pound fine last season for a far more serious breach of the rules. No points deduction
Sheffield were robbed.
win rhe playoffs leeds

A 15 point deduction caused by the IR and ratified by L1 managers, how's that fair. A fan for 42 years, my club's been used & abused by many in the past to increase their own gain & glory. As now it's the team & fans who are punished. Yes we're bitter, yes we have a grudge. Cmon lads take us up!

Whatever you think of Bates it's amazing how many people are so ill-informed about the Leeds saga. The Inland Revenues legal action forced Leeds into abandoning the CVA, thereby breaching FL "rules" and leaving Leeds open to a FL 15point mauling. Fair and proportionate? No! God help Bournemouth.

The appeal should have been assessed points of law and not as it seems what would happen with other clubs should Leeds get the points back. There is an amount of the old boys network here. Leeds united should now go on and win the play off final and Ken can stick two fingers up to the lot of them.

To start a season without all those points would have morally destroyed any other club. But not Leeds United. I think all the other clubs just have pure old beef for Leeds; which isn't healthy for them. They should see Leeds as a Role Model and nothing more. After all, its only football

Sorry but the appeal was doomed to fail. Bates agreed to cop 15 points instead of the other option; playing this season in League 2. Bates has taken everyone for a ride & made Leeds a laughing stock when the team has done so well this season. No journo seems to have noticed this crucial fact.

Leeds and Ken Bates are made for each other. I doubt any in the championship will miss them or their unpleasant supporters.
james, burnley,
Whatever the legal position, this was undoubtedly handled in an appalling way by the Football League. Congratulations for Leeds for making it to 2nd in real terms, despite the psychological barrier of a 15 point handicap.
David, Paris,
Bates is the most disliked Club Chairman in the entire football league. Looking at his comments following the Panel's decision it is not hard to see why. We were shafted by the other Club Chairmen and it was partly because of Bates and his tactics . The answer is to win the play offs.
George Thornton, London, UK
Tribunal Postscript:
We feel obliged to record that we consider an Appeal to Members of the League to be unsatisfactory. Some clubs in the same league may not readily agree to reduce a points sanction in the understandable self-interest of their clubs.
Recommends independent tribunal.

I truly hope that the Leeds fans can put this to the back of their minds now & concentrate on getting through the play-offs because they are a "BIG" club In all senses (I support Nott'm Forest) theyve had a rough ride In all this & It tends to alway's be the Fans that suffer! "Reddogsimmo"

The best team in the division by a street mile. Dont worry Leeds the playoffs will hold no fears for you. It will be Leeds back in the Championship next season, no problem.D
D Walker, Measham, England
I am delighted at this. Leeds have soured the division with this action. To decide on a 15-point decision in May with 45 out of 46 games played is scandalous to say the least and the FL board also needs to review its procedures. The Swans are champions!!!! Justice = Leeds to lose in the play-offs.
